SANITINO is committed to transparent processing of personal data and, therefore, provides the following information.

SANITINO s.r.o., a company with its registered office at Moravská 1259, 570 01 Litomyšl, Id. No.: 275 45 423, registered in the Commercial Register kept by the Regional Court in Hradec Králové under File No. C 25189 (hereinafter “SANITINO”), operates an e-shop at www.sanitino.dk/en (hereinafter the “E-shop”).  SANITINO, as the personal data controller, uses all efforts to protect the privacy of all customers and other data subjects and guarantees confidential handling of all personal data it processes.

For the purposes of this notice, the following terms shall have the respective meanings:

• Registered User – a person who has a user account opened in the E-shop, regardless of whether or not he/she has made a purchase from SANITINO.
• Unregistered User – a person who has visited the E-shop, regardless of whether or not he/she has made a purchase from SANITINO
• Helpline User – a person who has made a telephone call with a helpline operated by SANITINO at +420 468 006 468.
• Customer – a registered or unregistered user who has made a purchase from SANITINO.
• Users – jointly Registered Users, Unregistered Users, Helpline Users, Customers.

The processing of all personal data of Users takes place in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as amended, and other related regulations.

Processing of Users’ personal data

SANITINO processes the Users’ personal data only for the purposes specified below. Users are not obligated to provide SANITINO with any of their personal data; however, collection and further processing of said data is necessary in case Users wish to make use of services or offerings provided by SANITINO via the E-shop. Also, data may be processed automatically due to merely accessing the E-shop to the extent outlined subsequently.

SANITINO can process personal data both manually and by automated means.

1. Performance of the purchase contract

Purpose:

SANITINO processes these personal data for the purpose of conducting its business activity and to be able to provide its services as offered.

Type and extent of data processing:

SANITINO processes the following Users’ personal data: name, surname, business name, address of residence or registered office, mailing address, billing address, e-mail address, identification number, tax identification number. Within this context, SANITINO can also process other data being necessary in the individual case or voluntarily provided by the Customer for this reason, such as telephone number.

Legal basis:

SANITINO processes User’s personal data on the basis of mutual contract, User’s preceding request or SANITINO’s legitimate interest in executing the contract. Any additional processing of data provided voluntarily by the Customer is based on SANITINO’s legitimate interest in using voluntary information to simplify processes and to provide its services as comprehensive as possible from a quality point of view.

Storage period:

SANITINO stores said data for the term of performance of the contract and, subsequently, for a further period of 5 years.

2. Keeping the user account

Purpose:

SANITINO processes personal data for the purpose of providing Registered Users with expected characteristics and functions of an e-shop and to simplify their future ordering processes.

Type and extent of data processing:

SANITINO processes the following Users’ personal data: name, surname, business name, address of residence, mailing address, billing address, e-mail address, identification number, tax identification number, and other data provided during the registration of the user or during the time when the user account is kept. Within this context, SANITINO can also process other data voluntarily provided by the Customer for this reason, such as telephone number.

Legal basis:

SANITINO processes User’s personal data on the basis of mutual contract because such processing is necessary for the performance of a contract. SANITINO also processes User’s personal data on the basis of its legitimate interest in enhancing functions of the E-shop and quality of its services.

Storage period:

SANITINO stores said data for a period of 5 years from registration or 5 years from the last purchase, whichever period ends later.

3. Resolving queries and requests

Purpose:

SANITINO processes personal data in order to maintain a properly functioning contact system that enables SANITINO a necessary exchange with its Users.

Type and extent of data processing:

In order to handle the User’s queries/contact request and deal with it, SANITINO processes the data provided by the User within this context, e.g. name, surname, telephone number, e-mail address and/or any other data as indicated.

Legal basis:

SANITINO processes User’s personal data on the basis of its legitimate interest in allowing and maintaining an exchange with User’s to answer their queries and requests.

Storage period:

SANITINO processes these personal data for the period of actively processing the request or query and, subsequently, for a further period of 5 years

4. Improvement of customer service

Purpose:

SANITINO processes  voice recordings of phonecalls for the purpose of providing its customers with the highest standard of customer service as well as to constantly improve customer experience as much as possible. SANITINO uses these recordings to evaluate the customer service given to its customers in order to make it better and more efficient. ANITINO may also analyse these recordings and use them to create a database of queries to which it provides answers on the E-shop website.

Type and extent of data processing:

SANITINO processes recordings of calls made to the helpline.

Legal basis:

SANITINO processes User’s personal data on the basis of Helpline User’s consent. The Helpline User is always informed by SANITINO before any recording and, if the Helpline User does not provide his or her consent, the call will not be recorded.

Storage period:

SANITINO stores said recordings for a period of 5 years.

5. Compliance with SANITINO’s legal obligations

Purpose:

SANITINO processes personal data for the purpose of fulfilling its own legal obligations being applicable in the respective individual case.  

Type and extent of data processing:

SANITINO processes the Users’ data where legally prescribed for specific cases, such as in regards to accounting provisions in connection with purchases made via the E-shop. Such processing may include, for example, the User’s name and surname or business name, address of residence or registered office, mailing address, billing address, identification number, tax identification number, date of birth or birth identification number, e-mail address, telephone number, bank details, and other data provided by the User, if applicable.

Legal basis:

SANITINO processes personal data also on the basis of compliance with the legal obligations to which SANITINO is subject.

Storage period:

Personal data shall be processed for the period required by the relevant legal regulations.

6. Sending commercial communications

Purpose:

SANITINO processes personal data in order to give Users information about its products and commercial information.

Type and extent of data processing:

In order to send commercial communications to interested Users, SANITINO processes the following Users’ personal data: name, surname, e-mail address.

Legal basis:

SANITINO may send commercial communication to Users who subscribed to its newsletter, based on their consent. Users who have granted consent will be sent an e-mail to confirm their e-mail address and interest in obtaining the newsletter (will be asked to double opt-in). Users can unsubscribe from the newsletter using a link provided in each individual newsletter. Also, Users may withdraw previously granted consent to the processing by submitting an informal request as illustrated under Users’ rights.

Storage period:

Personal data may be processed in this manner for a period of 5 years from the last order or from granting the consent.

7. Enforcement of SANITINO’s legal claims

Purpose:

SANITINO processes personal data for the purpose of establishing, exercising or defending any supposed legal claims.

Type and extent of data processing:

In order to establish, exercise or defend legal claims, SANITINO may process any of the following User’s data in the individual case: name and surname or business name, address of residence or registered office, e-mail address, telephone number, identification number, tax identification number, date of birth, scope and subject of performance and, and if appropriate, other necessary data.

Legal basis:

SANITINO processes personal data on the basis of its respectively the User’s legitimate interest to enforce existing rights or defend legal claims.

Storage period:

Personal data shall be processed in this manner for a period of 5 years from the date of commencement of personal data processing unless the legal regulations specify otherwise, or unless the need to store personal data for a longer period arises in a specific case.

8. Processing of access data when visiting the E-shop

Purpose:

Server log files are created and stored for the purpose of establishing and maintaining technical security.

Type and extent of data processing:

When accessing the E-shop, certain access data are processed automatically in so-called server log files; in particular, the following data are processed within this context: (i) name of visited website; (ii) browser type/version used; (iii) operating system of the User; (iv) previously visited website (referrer URL); (v) time of the server request; (vi) data volume transferred; (vii) host name of the accessing computer (IP address). This information does not allow SANITINO to identify Users personally; however, IP addresses are considered personal data.

Legal basis:

SANITINO processes personal data on the basis of its legitimate interest to establish and maintain technical security.

Storage period:

Data contained in server log files are stored for a period of 5 years.

Other recipients of personal data

Personal data may be transferred to public authorities and contractual partners of SANITINO.

1. Public authorities

SANITINO discloses personal data to public authorities only on the basis of instructions of the data subjects and also in cases where this is required by the law or on the grounds of protection of the legitimate interests of SANITINO or third parties. Public authorities act as independent controllers of your respective personal data.

2. Contractual partners

SANITINO may also transfer personal data to contractual partners if relevant and appropriate for the purpose of the respective processing activity. Contractual partners may either act as controllers themselves or as processer that are bound by our instructions.

Providers of services associated with customer communication

SANITINO shares personal data with certain partners who help SANITINO ensure communication with the customers, e.g. arrange for sending newsletters or operate the helpline. Data shared in this way may include the name, surname, business name, address of residence or registered office, mailing address, billing address, e-mail address, telephone number, identification number, tax identification number or order details.

Users’ rights

Right of access to personal data

Users have the right to obtain information on whether their personal data are processed and, if so, they also have the right to gain access to their personal data. If the Users have any queries or requests concerning the processing of their personal data, they may contact SANITINO.

Right to rectification of personal data

If the Users believe that SANITINO processes inaccurate or incomplete personal data, they have the right to request their rectification or supplementation.

Right to erasure

If the Users request erasure of their personal data, SANITINO shall erase their personal data if (i) they are no longer necessary for the purposes for which they were collected or otherwise processed; (ii) the User has withdrawn the consent to the processing of personal data, such personal data were processed on the basis of consent and there is no other legal ground for the processing; (iii) the User has objected to the processing and there are no overriding legitimate grounds for the processing of the User’s personal data; (iv) the processing is unlawful; or (v) the legal obligation to process the personal data based on European Union law or national law has ceased to exist.

Right to restriction of personal data processing

Until SANITINO resolves any disputable issues regarding the processing of the Users’ personal data, the Users have the right to request restriction of processing of their personal data. Where processing has been restricted, the Users’ personal data may be processed, except for their storage, only with the Users’ consent or for the purpose of establishing, exercising or defending legal claims, for the protection of third-party rights or for reasons of an important public interest of the European Union or any Member State.

Right to data portability

Users have the right to obtain personal data concerning them (i) which they provided to us; (ii) which are processed based on consent or contract; and (iii) which SANITINO processes by automated means; all that in a structured, commonly used and machine-readable format, as well as the right to have such data transferred to another controller. However, if the exercise of this right would adversely affect the rights and freedoms of other persons, SANITINO will not be able to satisfy the Users’ requests.

Right to object

Users have the right to object to processing of personal data that are processed for the purposes of performing a task carried out in the public interest or in the exercise of official authority or for the purposes of protecting the legitimate interests of SANITINO or legitimate interests of third parties. If SANITINO subsequently fails to prove that there exist serious legitimate grounds for personal data processing which override the interests of Users or their rights and freedoms, or that SANITINO needs the processing for the establishment, exercise or defence of legal claims, SANITINO will terminate the processing on the basis of the objection without undue delay. Moreover, Users have an unconditional right to object to any processing of their personal data being executed for direct marketing purposes.

Right to withdraw

Users have the right to withdraw their consent granted for the processing of their personal data at any time. However, the withdrawal of Users’ consent does not retroactively affect the lawfulness of data processing based on such consent – it solely affects subsequent processing activities. After the exercise of said right, SANITINO will terminate the affected processing activities without undue delay.

Any requests regarding the assertion of any of the abovementioned rights or anyquestions concerning personal data processing will be answered to the Users shall be directed by telephone to +420 468 006 468 or by e-mail at info@sanitino.dk.  

SANITINO shall then answer Users’ requests as soon as possible and within one 1 month at the latest (in exceptional cases, restrictions on these rights are possible, for instance, if otherwise the rights of third parties would be affected). In case of doubts concerning compliance with the obligations, the Users may contact SANITINO by telephone at +420 468 006 468 or using e-mail address info@sanitino.dk or, if appropriate, they may lodge a complaint with the national supervisory authority.
